Welcome to JobSearch Works ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the JobSearch Works platform, including our website at https://jobsearch.works and related services (collectively, the "Service").

IMPORTANT: Our Service uses artificial intelligence (AI) to automate job applications on your behalf. Please read Section 6 (AI-Powered Application Services) carefully to understand how this works and your responsibilities.

2. Definitions

  • "User," "you," or "your" refers to any individual who accesses or uses the Service
  • "Account" refers to the user account created to access the Service
  • "Content" refers to any information, data, text, documents, images, or other materials uploaded, submitted, or transmitted through the Service
  • "AI System" refers to the artificial intelligence technology used by the Service to generate application content and automate submissions
  • "Application Content" refers to resumes, cover letters, form responses, and other materials generated or submitted by the AI System on your behalf
  • "Profile Data" refers to personal information, work history, skills, preferences, and other data you provide to build your user profile
  • "Platform" refers to the JobSearch Works website and application

3. Eligibility

You must be at least 18 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration and Security

4.1 Account Creation

  • You must create an account to access certain features of the Service
  • You must provide accurate, current, and complete information during registration
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account

4.2 Account Security

  • You must notify us immediately of any unauthorized access or security breach
  • You must not share your account credentials with others
  • We reserve the right to suspend or terminate accounts that violate these Terms

4.3 Account Termination

  • You may terminate your account at any time through your account settings
  • We may suspend or terminate your account for violations of these Terms
  • Upon termination, your right to access the Service will immediately cease

5. Use of the Service

5.1 Permitted Use

You may use the Service for lawful purposes only, including:

  • Creating and managing your job seeker profile
  • Searching and applying for job opportunities
  • Tracking your job applications
  • Managing your resume and application materials
  • Authorizing AI-assisted job applications

5.2 Prohibited Use

You may not:

  • Use the Service for any illegal or unauthorized purpose
  • Violate any laws in your jurisdiction
  • Infringe upon the rights of others
  • Upload malicious code, viruses, or harmful content
  • Attempt to gain unauthorized access to any portion of the Service
  • Impersonate any person or entity
  • Harass, abuse, or harm other users
  • Submit false, misleading, or fraudulent information to your profile
  • Use the Service to misrepresent your qualifications to employers
  • Use the Service to spam employers or send unsolicited communications

6. AI-Powered Application Services

This section describes how our AI system works and is critical to understanding your use of the Service.

6.1 Service Description

JobSearch Works uses artificial intelligence to help automate your job search process. When you use our Service, the AI System may:

  • Generate tailored resumes and cover letters based on your Profile Data
  • Answer application form questions using information from your profile
  • Automatically fill in application forms on employer websites
  • Submit job applications to employers on your behalf
  • Monitor your connected email account for job-related communications

6.2 Your Authorization

By using the Service and clicking "Apply" or similar actions, you:

  • Authorize us to act as your agent for the purpose of submitting job applications
  • Grant permission for the AI System to generate Application Content based on your Profile Data
  • Consent to automated submission of applications to employers
  • Acknowledge that applications submitted by the AI System are legally binding as if you had submitted them yourself

6.3 AI Accuracy and Limitations

Important Notice

The AI System generates Application Content based on information you provide. While we strive for quality and accuracy, AI-generated content may contain errors, inaccuracies, or omissions. The AI System, like a human, can make mistakes.

You acknowledge and accept that:

  • AI-generated responses may not perfectly represent your qualifications or intentions
  • The AI may misinterpret application questions or provide inappropriate answers
  • Generated resumes and cover letters may contain factual errors
  • The AI cannot guarantee compliance with all employer-specific requirements
  • Automated form-filling may occasionally select incorrect options or miss required fields

6.4 Your Responsibilities

When using AI-powered features, you are responsible for:

  • Providing accurate Profile Data: The quality of AI output depends on accurate input
  • Reviewing Application Content: Where possible, review AI-generated content before submission
  • Accepting risk of errors: If you enable automatic submission without review, you accept the risk of errors in applications
  • Ensuring truthfulness: You warrant that your Profile Data is truthful and you are not using the Service to misrepresent yourself to employers
  • Monitoring applications: Regularly check your application status and address any issues

6.5 Third-Party Platform Compliance

Platform Risk Notice

Some job platforms (such as LinkedIn, Indeed, and others) may have terms of service that restrict or prohibit automated applications. Using our Service may result in restrictions or suspension of your accounts on these platforms. We are not responsible for any actions taken by third-party platforms.

7. Gmail and Email Integration

Our Service may integrate with your Gmail or other email accounts to:

  • Discover job opportunities from email notifications
  • Monitor responses from employers
  • Track application status updates
  • Categorize job-related communications

By connecting your email account, you authorize us to access and process emails related to your job search. We will only access information necessary to provide the Service and will handle your data in accordance with our Privacy Policy and applicable Google API Services User Data Policy.

8. Privacy and Data Protection

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to our collection and use of data as described in the Privacy Policy. We implement reasonable security measures to protect your data.

9. Intellectual Property

The Service, including all content, features, and functionality, is owned by JobSearch Works. Our trademarks, logos, and branding are protected by intellectual property laws. You may not use our intellectual property without our written permission.

We grant you a limited, non-exclusive, non-transferable license to access and use the Service. This license does not include the right to reproduce, modify, or distribute our content.

10. Disclaimers

10.1 Service Provided "As Is"

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

10.2 No Employment Guarantees

We do not guarantee that use of the Service will result in job interviews, job offers, or employment. The success of your job search depends on many factors outside our control, including employer decisions, market conditions, and your qualifications.

10.3 AI Output Disclaimer

We do not warrant that AI-generated Application Content will be accurate, complete, appropriate, or free from errors. You should not rely solely on AI-generated content without review where practicable.

11. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for any indirect, incidental, special, consequential, or punitive damages
  • Our total liability shall not exceed the amount you paid to us in the past 12 months, or AUD $100, whichever is greater
  • We are not liable for damages arising from your use or inability to use the Service
  • We are not liable for third-party actions, content, or services

Without limiting the above, we are specifically not liable for:

  • Errors or inaccuracies in AI-generated Application Content
  • Failed or rejected job applications
  • Lost employment opportunities
  • Damage to your reputation with employers
  • Suspension or termination of your accounts on third-party job platforms
  • Actions taken by employers based on applications submitted through our Service
  • Loss of data or unauthorized access to your account

12. Indemnification

You agree to indemnify, defend, and hold harmless JobSearch Works and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; (d) any content you submit through the Service; or (e) applications submitted on your behalf through the AI System.

13. Modifications

We may update these Terms from time to time. We will notify you of material changes via email or platform notification. Your continued use of the Service after changes constitutes acceptance. You should review these Terms periodically.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Australia.
